Imagine you went out with your mother to go grocery shopping. In the market, a person approaches your mother and starts giving death threats and assaulting her. In that case, you might become fierce and attack the person to protect your mother. You managed to subdue the attacker and are now waiting for the police. This very act is called self-defense.

Unfortunately, when you go too far and use physical force more than limited in Oklahoma, it may become an offense and not a self-defense case. Therefore, having a good knowledge of the laws is crucial. If you have been unlawfully arrested in a self-defense case, a Yukon criminal defense lawyer can review your case and help you get justice.

Three common situations where you can not claim self-defense.

If you are being attacked or someone physically threatens you, the law gives you the right of self-defense to protect yourself from damage or injury. However, there are some exceptions to this rule as well. These are as follows:

    • Defense becoming an attack: If a person is threatening you or causing you harm, you can use physical force to defend yourself or any other person. However, it is essential to remember that there are limitations to using physical force. Laws vary according to the states; however, you should stop or withdraw from a fight after the attacker is subdued breakingtimes.

If an attacker attacks, you can use self-defense to protect yourself. When the attacker is on the ground, and you have time to run, if you keep hitting him, self-defense will no longer be applicable, and your attack will contribute to an offense.

    • Felonious activity: You can only use the right of self-defense for legally appropriate behavior. People who violate laws or get involved in criminal activity may face violent pushbacks when they try to rob someone or steal their property. In that case, if the offender attempts to protect himself and uses physical force, they can not have a self-defense claim in court.
    • Resisting arrest: If the police arrest you for a crime, whether you have committed it or not, you have no right to use self-defense and resist the arrest. It is highly advised to call a criminal defense attorney immediately. They can review your case, and if you are innocent, they will help you get compensation infonewsmedia.

    What is self-defense?

When using a self-defense claim, you are telling the court that your act of using physical force was justified and needed to protect yourself from injury or threat. To prove it, you must show that the harm threatened you and you did not start an attack.

Self-defence can also be used to protect someone other than yourself. A mother can use self-defense to protect her child, or you can use it to defend your home or personal property.

If you were charged with an offense for defending yourself, you may be scared. Hire an attorney to seek legal assistance usainfopress.
